Geraldo Rivera on CNN last night:

“GERALDO RIVERA, JOURNALIST: Well, I liked them before the election so people could make a more reasoned judgment when they were voting for whoever they’re going to vote for. But that’s not the issue. The Supreme Court doesn’t care whether or not it’s fair. It cares whether it’s legal.

So, he’s being charged with obstruction of the election or conspiracy to obstruct the election. But the issue is, and Trump alleges, that he has absolute immunity for any crime committed when he’s president. So, the Supreme Court has decided to litigate that. They’re going to decide whether or not Trump has absolute immunity.

I mean, there are other defenses that he has, like double jeopardy and some of the others. But the main one is this absolute immunity. Are presidents absolutely immune from criminal prosecution for acts committed while they are in office? And so far, Trump’s been losing on that. But we’ll see.

RIVERA: I — right now, I think that the Supreme Court is going to look at this statute, this conspiracy to obstruct statute, and they’re going to decide whether or not it’s constitutional. The case against President Trump is hanging by a thread, I think, right now.

It is — to get this thing done before election is going to be extremely difficult. The Supreme Court is going to come down with their decision probably in June, then it’s going to be July, and before you know it, it’s going to be an election. I don’t know how they could possibly do it physically before the election.

RIVERA: Well, that may be true, Abby, but the Supreme Court also, one thing Philippe did not mention, is deciding whether or not the very statute under which he is accused in this main case, the Jack Smith case, these four counts in the indictment, whether or not the statute itself is appropriate, whether or not it is constitutional, whether or not you need corrupt intent.

It’s not only Trump’s case that hangs in the balance right now, Abby. It’s hundreds of January 6th rioters. Their cases also hang in the balance. And whether or not the very statute under which they are accused, even — Philippe may not like Trump. That’s not relevant. What is relevant is what is constitutional, what is appropriate.

There’s a reason presidents have not been arrested before. There’s a reason that they’re not indicted. They are impeached. He has been impeached twice. He has also been acquitted twice by the Senate of the United States.

Trump argues, maybe successfully, maybe farfetched, that that is double jeopardy. The court, the original court of jurisdiction, has said no, it’s not double jeopardy. But the Supreme Court has now decided that they want to rule on this case.

RIVERA: Is there corrupt intent? I — Abby, trust me, it is shocking to me as well that the Supreme Court took this case and they are now reviewing the case of whether or not the very statute is constitutional. It is — they say, their statute requires corrupt intent, not only corrupt intent.

So, was there corrupt intent? You know, that is something that will be litigated, but it is, by no means, a slam dunk. It is nerve-wracking. Ask Jack Smith how he feels tonight that the Supreme Court has taken these cases.

RIVERA: Who is on the Supreme Court? Hold on. who is on the Supreme Court of the United States right now? Is it not a fact that Trump has managed to put three justices on the Supreme Court and now there’s a conservative 6-3 majority? I think your complacency and attitude that this thing is going to go ahead and you’ll get it done in a timely fashion.

What people have to grasp is, and with all due respect, I really believe that this issue of corrupt intent will screw up all of the schedules that people have and I believe that it will be physically impossible for the Supreme Court and everybody else to rule in time for the election. I don’t believe that that will happen.

It is in Trump’s interest.”

I’m showing you Geraldo Rivers’a response and opinion on Donald Trump’s immunity claim, because he was on CNN’s Newsnight With Abby Phillip last night, essentially trying to make Trump World’s (or what’s left of Trump World) argument for why Donald Trump shouldn’t be tried at all right now, at least until he’s President again and can just unilaterally throw all these Federal cases out that are against him.

I think what Geraldo is really doing here, is campaigning to be Donald Trump’s attorney attorney, similar to what Alan Dershowitz was doing on his podcast a couple months ago, by making the garbage argument that Donald Trump is immune to all prosecutions against him, simply because he’s currently running for President right now. I’m not a lawyer, but I love to see the statue or the section in the U.S. Constitution where it says that presidential candidates are immune from prosecution, or even about the law, simply because they are presidential candidates.

But with Geraldo Rivera, unlike most of his other lawyers like Alina Habba and others, at least he tries to sound intelligent and put a real argument together, unlike Trump’s Washington lawyers right now who are literally arguing that there should be a delay here, because it’s the holiday season and they need to spend time with their families. Apparently they were asleep in law school on the day when they were told that bering a lawyer, especially a criminal defense lawyer and prosecutor, involves a lot of hard work and personal sacrifice.

I agree with Harry Litman that this delay with the Trump appeal on immunity, will probably delay the Washington trial by a month or so. But DJT will lose that as well, simply because their argument is ridiculous, (and that might be putting it mildly) because no one is above the law in this country, including former President’s and presidential candidates. And that this trial will probably start in April or May, maybe June and DJT will be convicted by the end of the summer 2024.

“NEW YORK — Donald Trump cannot use presidential immunity to avoid a defamation lawsuit from the writer E. Jean Carroll, a federal appeals court ruled Wednesday after finding that Trump waited too long to invoke the defense.

It’s the third time in recent weeks that federal courts have rejected immunity arguments from Trump as he battles multiple legal fronts in criminal and civil cases.

The ruling paves the way for Carroll’s lawsuit to proceed to trial in January. The case concerns comments Trump made about Carroll in 2019, shortly after Carroll came forward and accused Trump of raping her decades earlier. Trump said Carroll was peddling a false accusation and was motivated by money.

Three years after Carroll sued Trump for defamation over those comments, Trump attempted to assert presidential immunity, a broad doctrine that shields presidents from lawsuits arising from their official acts.

But on Wednesday, a three-judge panel of the 2nd Circuit Court of Appeals found that Trump had waived his right to use the immunity defense because he waited too long to invoke it.

“We hold that presidential immunity is waivable and that Defendant waived this defense,” a three-judge panel of the 2nd Circuit Court of Appeals wrote.

All three judges on the panel were appointed by Democratic presidents.

Trump has attempted to evade many of his legal troubles by mounting aggressive immunity defenses, claiming that virtually anything he did while president cannot subject him to civil liability or criminal consequences. But courts have largely rejected those arguments so far.

Earlier this month, U.S. District Judge Tanya Chutkan ruled that Trump is not immune from prosecution for his attempt to subvert the 2020 election. Trump appealed that decision, prompting special counsel Jack Smith to take the issue directly to the Supreme Court in hopes of obtaining a swift and definitive ruling on the question.

Chutkan’s ruling came just hours after the D.C. Circuit Court of Appeals rejected Trump’s claims of immunity from a series of civil lawsuits that seek to hold him accountable for stoking the attack on the Capitol on Jan. 6, 2021.

In the Carroll decision on Wednesday, the 2nd Circuit panel also said it did not have jurisdiction to review a trial judge’s ruling that Trump did, in fact, defame Carroll with his 2019 comments. With that ruling in place, a jury will decide at the January trial how much money in damages Trump should pay to Carroll.

The January trial will be the second trial Trump will face tied to Carroll’s rape allegations. Earlier this year, a jury found that Trump sexually abused Carroll in the 1990s and that he defamed her in 2022 when he called her account a “hoax.” The jury ordered Trump to pay Carroll $5 million.”

As I wrote about Alina Habba back in November on The New Democrat :

“When you are the President of the United States, regardless of the POTUS, you have access to be the best of legal profession in this country. Any lawyer just about would be honored to either work in your White House, or work as your personal attorney to address any personal legal issues that you might have when you are President. At least access to the best lawyers in your own party.

But when you leave The White House, especially in disgrace, when you’ve just lost reelection and only managed 46% of the popular vote and 232 out of 574 electoral votes, in a two-way race, you’ve been impeached twice in just 4 years, you have all the legal issues that are now in front of you because of your illegal conduct as President of the United States, you are very unpopular, at least outside of your own party, you have mounting financial debt in front of you because of all the money that you lost when you were President, you have access to whatever is left.

Alina Habba is not really a trial lawyer. She can barely afford to do whatever she does as a lawyer right now. She’s more of a public relations lawyer, if anything at all, who makes her living trying her client’s cases on TV and on social media. But she’s officially Donald Trump’s civil lawyer right now because she’s about the best of what’s left to try to defend him, because of his own financial situation and all the evidence that’s against him right now, in multiple cases.

Perhaps one of the reasons right now that Alina Habba owes millions of dollars, is because her own client is not paying her. But she’s trying to work for him anyway, perhaps banking on the fact that defending a former President of the United States, would lead to clients who can and would pay her very well for her legal advice and actions in the future. But that career strategy is obviously not working out for her right now. ”

So to put all of this in English: (or perhaps broken American English) Donald Trump lost his civil immunity case in the E. Jeanne Carrol case, because his own damn lawyer Alina Habba, didn’t file her motion in time to win that appeal and give her client civil immunity here.

My post about DJT’s lawyer Alina Habba from back in November still stands here. She’s not up to the task, doesn’t have the experience, the knowledge, the professionalism, to defend a client at the level of Donald Trump, when you are talking about a former President of the United States and now serial criminal defendant.

DJT needs much better legal representation. But Alina Habba might be the best of what’s left to even consider representing a man who not only commits felonies on a regular basis, but who leaves incriminating evidence against him all over the place, either thinking he’ll never get caught, or convicted, or he’s simply above the law and has some constitutional right that no other American citizen has.

Not only I’m not a lawyer, but I’m also not a psychologist, not even a political psychologist. So what I’ll be doing here is just theorizing and sort of using New York Times national political reporter and CNN political analyst Maggie Haberman as my source here.

I would have to assume that you would have to be a world champion narcissist to believe that you are always right and will always win everything to be Donald Trump. And I’m talking about him in his last two months of his presidency, where he’s desperate to remain as President of the United States, even though it’s clear he just lost reelection in November, 2020.

So on one side, President Trump has a team of lawyers and advisers from Wisconsin, who are essentially stating the obvious to him and telling him that it’s basically over. He’s not only lost Wisconsin, Michigan, and Pennsylvania, which clinched the election for Joe Biden. So now we know that Joe Biden will become the next President in January 2021.

But President Trump has this other lawyer who just happens to be one of his co-defendants in Georgia, Ken Chesebro, telling the President that he still has one more option in Arizona. But even if President Trump wins that legal case in Arizona, he’s still lost the presidential election and will legally be out of office in January, 2021.

And even after knowing all of this now knowing he’ll no longer be President, because he’s lost the Electoral College, President Trump still fights on because he’s being told by Ken Chesebro that he can win in Arizona. Even Arizona alone with all the other losses in the swing states that he had to win, to get reelected, won’t give him reelection.

I’m not saying the Ken Chesebro testimony about Arizona is not important. I’m just saying that we now know that Donald Trump knew he would be no longer be President of the United States by January 20, 2021. But he still went ahead with his illegal election interference campaigns, as well as inspired his MAGA followers, to try to take over the U.S. Capitol on January 6, 2021, the day that Congress made it official that Joe Biden won the 2020 presidential election and would become the next President of the United States, on January 20, 2021.

Kenneth Chesebro is a co-defendant in the Fulton County, Georgia, election overturning case, that’s being prosecuted by District Attorney Fani Willis. But he’s a cooperating co-defendant, which means he pleaded guilty to a felon here in Georgia, in exchange for a lighter sentence, that probably keeps him out of prison.

But to stay out of prison, Ken Chesebro has to spill the beans, (to use an old cliche) he has to let the dogs out (to use a more modern phrase) and tell Fulton County DA everything that he knows about his involvement, in trying to overturn the 2020 presidential election and just automatically declare Donald J. Trump as the winner of the 2020 presidential election.

I think we already knew that even Donald Trump knew that he lost the 2020 presidential election. People who worked directly for him in his White House, including his communications director Alyssa Farrah Griffin, as well Cassidy Hutchinson, who worked for his Chief of Staff Mark Meadows, as well as Mark Meadows, and Vice President Mike Pence, have already said that President Trump knew that he lost the 2020 presidential election, before the January 6, 2021 insurrection.

But what we have now with the Ken Chesebro tapes, is Chesebro and other lawyers telling Donald Trump that he lost the 2020 presidential election, before January 6, 2021. And Chesebro essentially saying that their might be one more legal play that they can try before Congress certifies the 2020 presidential election, but if that doesn’t work, then they are now out of legal plays in this case to overturn the 2020 presidential election and declare Donald Trump the winner. With then President Trump probably using that to say: “If these legal moves don’t work, we are (meaning MAGA) are going to have to take action and physically overturn the election ourselves and physically take over the U.S. Capitol.”

Just a few points about what they were talking about here and then I’ll save you from hearing everything else that I think and know, for now.

As far as Hunter Biden, Bill Maher made the best point here. Actually, he made two great points. Maher said that there is one party that not only believes in the rule of law, but believes in it more than the other party.

Going back to the 1960s, at least, it’s the Republican Party that’s been stereotyped as the tough, law and order, rule of law party. But then the right-wing cult hero of right-wing cult heroes, took over what used to be the Grand Ole Party and what I at least would even argue use to be the Republican Party, in 2016 and is now just Donald Trump’s MAGA Party, where their policy when it comes to the rule of law is: “It’s not illegal when we do it. It’s only illegal when Democrats and real Republicans who oppose us, do it.”

John Avlon made an excellent point about that as well, where he said the indictment of Hunter Biden (whose just happens to be President Joe Biden’s son) proves that we have the rule of law in America. We have a Democratic President and a Democratic run Department of Justice, that just indicted Hunter Biden on tax evasion and having illegal possession of firearms. And he looks pretty guilty on both counts and was even willing to plead guilty this summer, in exchange for a lighter sentence.

Bill Maher went onto say how these MAGA members (not real Republicans) are now comparing Hunter Biden with Donald Trump. With Maher making the quick comeback (and I’m paraphrasing) that you don’t see mainstream Democrats defending Hunter Biden, or Senator Bob Menendez, for that matter and he’s not the Democrat’s hero.

As far as Vivek Ramaswamy, this is the first and hopefully the only time that I talk about him ever, at least until he grows up and perhaps takes and passes a course in social studies, as well as government and politics.

I think the only thing that explains his so-called presidential campaign (which is really just a poorly managed spinoff to Donald Trump’s hit reality TV show Who Wants To Be President?) is that he’s campaigning to be Donald Trump’s Vice Presidential nominee. He’s basically telling DJT: “I’m a bigger dick than you, even, and I know even less about government and public policy, than you, even. You have to pick me because we would be perfect together.” And we’ll see if that campaign works or not.

I would ask the simple question of what Donald Trump was thinking on January 6, 2021. But then I would have to assume that he was thinking about anything, other than being desperate to stay in power so much, regardless of what the American voters had just said about him being their President. And this was the last thing that he could think of, to do, to try to save his presidency, which was to inspire am insurrection on the U.S. Capitol and that joint session of Congress, to certify the 2020 presidential election and declare Joe Biden as President and Kamala Harris as Vice President.

The reason why I mention this, is because a more experienced, more competent, more moral, person, who served in government, especially the U.S. Government, before becoming President, would’ve come to the conclusion, even if they were considering an insurrection on the U.S. Capitol, that no way this would work.

At risking of being very offensive here: Donald Trump seemed to believe that the way for him to save his presidency, was essentially inspire a group of wannabe militia members, people with at best very limited law enforcement or military backgrounds, who were probably kicked out law enforcement, for incompetence, who have very little respect for the rule of law, and march down to the U.S. Capitol, to take over the joint session of Congress and just automatically declare Donald J. Trump as President again. And then somehow be able to occupy the Capitol, until their reinforcements came. And no one could get caught and get into trouble for this Super Bowl level of stupidity and irresponsibility.

And because of all this lack of planning by Trump Inc., they left evidence all over the place, like they were staking their claim and purposely letting the world know that they were there that day and this is what they did. Sort of like a family of hungry raccoons, who go through people’s trash and gardens, garages, looking for food for themselves. That’s why Donald Trump and his team are in so much trouble today, with the law, because they acted like a team of amateur, juvenile, convenient store, shoplifters, who left evidence all over the place, including as they were headed out the door.

“Like many reporters, I’ve been operating in Casaubon mode for much of the past eight years, searching for the key to Donald Trump’s mythologies. No single explanation of Trump is fully satisfactory, although Atlantic staff writer Adam Serwer came closest when he observed that the cruelty is the point. Another person who helped me unscramble the mystery of Trump was his son-in-law Jared Kushner. Early in the Trump presidency, I had lunch with Kushner in his White House office. We were meant to be discussing Middle East peace (more on that another time), but I was particularly curious to hear Kushner talk about his father-in-law’s behavior. I was not inured then—and am not inured even now—to the many rococo manifestations of Trump’s defective character. One of the first moments of real shock for me came in the summer of 2015, when Trump, then an implausible candidate for the Republican presidential nomination, said of Senator John McCain, “He’s not a war hero … I like people who weren’t captured, okay?”

Just to be completely honest and accurate: (not that I’m ever not completely honest and accurate) we don’t know what a 2nd Donald Trump presidency would look like. And besides that, he would have to get reelected first. And he might have to do that as a bankrupt and convicted felon, whose currently confined in prison, waiting on his sentence, after being remanded by Judge Tanya Chutkan. You can look at the polls all you want, but Donald Tump has a long, uphill, road to climb, before he even gets reelected again.

Having said all of that, I don’t want to wait and find out what a 2nd Donald Trump presidency could look like. I don’t think America can afford to take chance on him, because of what Jeffrey Goldberg and others have said. Which is why the U.S. Government, as well as American voters who love not just love America, but want to preserve and defend our liberal democracy, rule of law, and checks and balances, need to legally do whatever we can, to prevent Donald Trump from getting anywhere near The White House ever again.

As my colleague Fred Schneider wrote on The New Democrat last week: 

“That’s not the case with Donald J. Trump, who obviously is still an American citizen (as much as lot of Americans hate that fact and consider him an embarrassment to the country) and therefor is eligible to be tried for treason and insurrection, for his role in overthrowing the democratically, certified 2020 presidential election.

I don’t think there’s any question that Donald Trump has to be tried for his role in the 2021 insurrection, both in Washington and Atlanta, at least. Apparently Michigan, Nevada, and perhaps Pennsylvania, are considering their own prosecutions against the former President as well.

The reason why Donald Trump has to be tried for his role in January 6, 2021, is because if he weren’t at least tried, (and I’m very confident he’ll be convicted in Washington, at least) it would send a horrible signal to the rest of the far-right in America, that they could do this again in the future. As well as the militant far-left, who aren’t exactly in love with American liberal democracy either.”

As Paul G. Summers wrote for The Tennessean last year: 

“What is commonly referred to as The Rule of Law is the principle that all persons will be treated equally and justly in a civilized society.

No one is above the law. The highest aspirations of the rule of law are established in the Constitution of the United States and the Constitutions of the various states.

They are the bedrocks of our constitutional republics. They structure government; allocate and establish power and authority; and provide for the three basic branches of government. The constitutions provide freedoms and liberty.”

For the 100th time or whatever, we’re not lawyers at The New Democrat. We follow the news and report what know and tell our followers what we think about what we know.

Donald Trump is an American citizen like everyone else. His lawyers aren’t going to find anything in the U.S. Constitution that either puts former President’s above the law, or even Donald John Trump over or under any other American citizen.

It’s true that no sitting President can be tried while in office, (according to the U.S. Department of Justice) but sitting President and former President are two different statuses.

I think this is a brilliant move by Special Counsel Jack Smith because he knows how good of a case that he has against Donald J. Trump and he knows that Mr. Trump and his lawyers are simply trying to push this case beyond 2024 Election Day. And I expect, again as a non-lawyer, that the U.S. Supreme Court, perhaps even at least 2 of former President Trump’s own handpicked appointments, will see that Mr. Trump is simply trying to delay the Washington trial, because he doesn’t want to be convicted and remanded, especially before Election Day 2024.

Inside Politics With Manu Raju: Kevin McCarthy Has Warning For Donald Trump

Just a few points about former Speaker of the House Kevin McCarthy.

Yes, House Republicans won back the House last year. But they started off with 2012 seats and finished with 222 seats and now looks like they’re down to 220 seats, maybe 2019 in early 2024. Imagine investing 20 bucks in a lemonade stand and you net 40 cents back for your investment. That’s what you get with Kevin McCarthy in charge.

I think it was Representative Patrick McHenry (whose also returning from the House after next year) who said that Kevin McCarthy was one of the most effective Speaker’s that House Republicans have ever had. (Hard to write that down with a straight face) My question for Representative McHenry would’ve been: compared to who? And the list of possibilities at least in recent memory would be John Boehner, who did know how to manage his far-right and work with Democrats, to at least get the basics right when it came to government. But in recent years, I guess the other option would be Paul Ryan, who didn’t seek reelection in 2018, after only being Speaker for 3 years.

One of the panelists on this CNN show, Marianna Sotomayor said that Kevin McCarthy really knew how to recruit certain Republicans to run for certain House districts. Well, if Kevin McCarthy is actually a Democratic political operative undercover in the House, she has a point.

Again, House Republicans only picked up 10 seats last year, when they could’ve had 40, considering President Joe Biden’s un-favorability, the situation with the economy as far as inflation and high interest rates, the fact that the Democratic Party had complete control of Congress (House & Senate) in 2021-2022, as well as The White House.

But House Republicans have as much as 90-220 MAGA members. Some of those folks are perhaps even militant members of that movement, who aren’t opposed to using violence to accomplish their political objectives. Good thing Mr. McCarthy and the rest of the country that he isn’t a military recruiter.

What House Republicans got with Kevin McCarthy, was someone who wanted to Speaker of the House and perhaps do great things with his House majority. But I’m still trying to figure out how that benefits the House Republican Conference, the broader House of Representatives, the Republican Party, and the country in general.

This might sound like a crazy example: (hey it’s Friday the 8th, why not) but imagine going into your office one day with a machine gun, (don’t ask me how you got the gun into office) and you fire the gun all over the place and even hit a few people, leaving perhaps 50 witnesses who saw what you did, as well as the cameras that are in the building, as well as the office. And all these people are either your coworkers, or supervisors, perhaps subordinates, who know you fairly well and saw exactly what you did. So now you are on trial for manslaughter and perhaps attempted murder.

So now you are on trial and you have all these witnesses testifying against you, because you were too braindead and narcissistic to try to take a plea deal, or plead guilty in hopes you don’t go way for prison for the rest of your life, because you think the jury is going to fall in love with you, maybe the Governor is your brother-in-law and you are thinking he’ll automatically pardon you because you are family.

This is essentially the situation that Donald Trump is in, in Atlanta, Georgia. The only people that are going to testify against him in Atlanta, are his own, handpicked, appointments, to his presidential campaign, presidential administration, or his own personal lawyers.

Remember back in 2017 when then President Donald Trump said: “I only hire the best people to work for me.” Even if that were true, (and the Star Trek Enterprise is a real spaceship) even if he only hires the best people, according to him, the people he personally hired, are now going to help Fulton County, District Attorney Fani Willis, put him in prison for the rest of his life, if she only gets the chance
